Protection of personal data
Since May 25, 2018, when the General Data Protection
Regulation (GDPR) came into force, to say that the changes in the field of protection of natural persons regarding the processing of personal data have been tectonic would be an understatement. Following the example of the GDPR, the Republic of Serbia passed and, starting from August 21, 2019, the Law on Personal Data Protection entered into force. However, having in mind the fact that the legislator simply translated the provisions of the GDPR, it cannot be said that the text of the law is satisfactory, on the contrary. Due to such actions of the legislator, domestic practice must rely mostly on interpretations of the GDPR and the practice of European Union bodies.
In any case, the Law on Personal Data Protection brought about fundamental changes in the operations of companies and their obligation to incorporate the standards prescribed by the GDPR and the Law on Personal Data Protection into internal procedures, documentation and contracts.
In accordance with all the above, our office provides legal assistance on a number of aspects of the Law on Personal Data Protection to companies, whether it is advice on the implementation of the Law on Personal Data Protection in business, drafting internal acts of companies – regulations, procedures, risk analysis, DPAs, representation before the Commissioner for Personal Data Protection, or the engagement of a lawyer in the form of a Data Protection Officer (DPO).
